The role of the Motor Accident Injuries (MAI) Commission
The Motor Accident Injuries (MAI) Commission is headed by the MAI Commissioner. Its responsibilities include:
- reviewing premiums to ensure they fully fund the present and likely future costs of the scheme but are not excessive
- regulating the licensing of insurers under the MAI scheme
- monitoring insurer’s compliance with their obligations
- providing information to the public about the MAI scheme
- managing complaints about the market practices of licensed insurers under the MAI scheme
- monitoring and reviewing the MAI scheme, including developing guidelines and reporting to the Minister on how it is administered.
The Commission does not have powers to change a decision of an insurer regarding a defined benefit application or a common law claim.
The purpose of the Motor Accident Injuries Scheme
The way you’re covered by compulsory personal injury insurance if you’re involved in a motor accident in the ACT changed from 1 February 2020. Under the new scheme, Canberrans receive fairer, faster and more comprehensive support if they are injured in a motor vehicle accident.
Everyone who is injured in a motor vehicle accident is entitled to receive treatment, care and lost income benefits for up to five years – no matter who was at fault. This is different to the previous scheme that only covered people injured by an at-fault driver (third parties). It is a hybrid defined benefits common law scheme, with people who are more seriously injured being able to receive common law compensation.
The name of the scheme is the Motor Accident Injuries (MAI) Scheme (the previous scheme was the Compulsory Third-party (CTP) Insurance Scheme). Your policy is known as a Motor Accident Injuries (MAI) policy. Previous CTP insurance policies became MAI insurance policies on 1 February 2020.

- quick and transparent benefits to get recovery underway as soon as possible
- comprehensive and ongoing support for those who need it most.
