Welcome to the ACT Government’s Unclaimed Trust Moneys Database.

This website contains information on trust moneys held by the ACT Government and declared, as unclaimed trust moneys.  This website is centrally coordinated by the ACT Department of Treasury.  

The unclaimed moneys referred to at the Treasury website are specifically those moneys defined as ‘trust’ moneys under the Financial Management Act 1996. For example: money deposited with the Territory pending the completion of a transaction or the determination of a dispute and that may become repayable; money that is paid into a territory court for possible repayment to the payee or a third party because of any Act, order, instruction or authority; money that belongs to or is owing to any person and is collected by the Territory because of an agreement between the Territory and that person; or money that is paid to the Territory in trust for any other lawful purpose. Moneys that meet the definition of trust moneys are held in an agency managed trust banking account and are required to be declared unclaimed if not less than 6-years has elapsed since the date the money became payable and during that period no-one entitled to the money has requested the money be returned to them.

These unclaimed trust moneys do not include: unclaimed superannuation; bank account balances; life insurance policies; or company shares for example. Refer below for information relating to the location of other forms of unclaimed moneys.

Claim Procedures

All claims should be made in writing and directed to the ACT Department of Treasury.

All claims for unclaimed trust moneys must be supported with the originals of any documentary evidence relevant to establish proof of ownership.

Where original documentation is not available, the application should be in the form of a Statutory Declaration.

Completing a Statutory Declaration

A statutory declaration is a written statement declared to be true in the presence of an authorised witness.  A person wishing to use a statutory declaration in connection with a law of the Commonwealth, the Australian Capital Territory or certain other Territories must make the declaration in accordance with the Statutory Declarations Act 1959 (C'wlth) and the Statutory Declarations Regulations 1993.

Statutory Declaration forms can be downloaded from the Attorney-General's Department (Australian Government) website.

The declaration must state the claimant(s) current name and address.  Where this information differs from that included in this unclaimed trust moneys database, the claimant(s) must provide explanatory documentation (eg. copy of Marriage Certificate, Drivers Licence).

The claimant(s) must make a statement explaining their relationship to the Department that, prior to the moneys being declared unclaimed, held the money, the basis of their claim, details of the amount as published in this database and any other relevant information.

Locating other forms of Unclaimed Moneys

The Public Trustee for the Australian Capital Territory administers moneys that have been declared unclaimed under the Unclaimed Money Act 1950, the Agents Act 2003 and the Legal Profession Act 2006. There are different claim requirements under each of the acts. Unclaimed Moneys from bank, building society and credit union accounts are administered by the Australian Securities and Investment Commission (ASIC). Inquiries in relation to these types of unclaimed moneys should be made to ASIC. More information can be obtained from http://www.asic.gov.au.

Unclaimed Moneys in relation to superannuation are administered by the Australian Taxation Office (ATO). Inquiries in relation to these types of unclaimed moneys should be made to the ATO.  More information can be obtained from Australian Taxation Office (SuperSeeker).
